Poland to Close Labor Market to Foreigners Starting June 1, 2026 – What Does This Mean for Your Business?

Starting June 1, 2026, new regulations will come into force that redefine foreign nationals’ access to legal employment in Poland. The amendment to the Act on Foreigners (Article 116) introduces a hard block on the labor market for individuals arriving from countries such as Bulgaria, Romania, Slovakia, Hungary, Lithuania, and other countries in the region.

What’s changing?
New provisions have been added to the Act, allowing authorities to refuse to initiate proceedings for residence and work if the foreigner:

Is staying based on a visa issued by another Schengen state,

Holds a residence permit from another country,

Is staying based solely on an entry permit.

Exceptions?
Only for individuals benefiting from so-called mobility, i.e., strictly defined cases of rotational employment within EU member states.

Impacts on the labor market:
❌ No possibility to legalize employment in Poland for workers employed, for example, in the Czech Republic or Slovakia
❌ Reduced pool of available workers from the region
❌ Risk of losing skilled labor to foreign competition
